Amicus Brief: Jack Smith Not An 'Officer of the United States'

A lawyer named Josh Blackman announced that he has filed an amicus brief in the case of United States v. Trump (S.D. Fla.), one of the two prosecutions brought against Donald Trump by special counsel Jack Smith.

Blackman says that the brief is "on behalf of Professor Seth Barrett Tillman and the Landmark Legal Foundation," and it contends that Jack Smith is not an "Officer of the United States."

According to the brief, Jack Smith's position is characterized as an "employee," which means that Jack Smith should not be able to execute the broad prosecutorial powers of a United States attorney.

Blackman thinks that there's a possibility that this appeal could even entirely shut down the case against Trump.

Trump just needs to get these cases past Election Day 2024 so that he can win the presidency. If he's able to do that, a lot of these problems will just go away.

The only question is, how likely is Donald Trump to make it that long?
