Mistrial declared for Arizona man charged with murder for shooting illegal migrant

President Joe Biden's illegal immigration crisis has affected Americans in so many different and deadly ways.

The flood of illegals rushing across the border on a daily basis has put Americans who live on or near the border in tight spots, including one Arizona rancher who was arrested and charged for shooting and killing an illegal immigrant on his property.

According to ABC News, 75-year-old Arizona rancher George Alan Kelly was charged with second-degree murder and aggravated assault after the shooting, which occurred in January of 2023.

The outlet described the circumstances that led to the fatal shooting and Kelly's arrest.

"Law enforcement officials said Cuen-Buitimea was traveling with a group of migrants who ran when they saw border patrol agents in the area. Cuen-Buitimea and another migrant were allegedly heading back to the southern side of the border when they passed through Kelly's cattle ranch," ABC News reported.

Kelley reportedly opened fire on the migrant from about 115 yards using his AK-47 rifle.

This week, during Kelly's trial, a judge declared a mistrial. The jury had been deliberating since last Thursday.

While prosecutors in the case attempted to highlight inconsistencies in Kelly's story, Kelly's lawyers argued that there were plenty of inconsistencies on the side of law enforcement throughout the investigation.

ABC News noted:

Kelly's lawyers tried to poke holes in the prosecutor's account of the incident and accused law enforcement officials of failing to follow other leads that would have cleared their client of any wrongdoing. They also accused law enforcement of falsely claiming that Kelly admitted to shooting at multiple people.

Kelly's defense attorney said, "That was not true, Alan never said that. Law enforcement wasn't listening and they didn't care, they already decided that he was guilty."

Social media users reacted to the news of the mistrial, with many saying that the entire debacle was a waste of taxpayer's money, and that Kelly was innocent of any crime from the get-go.

"The government failed to do it. It’s their only obligation. They should be put on trial," one X user wrote.

Another X user wrote, "They will not retry this case because they have zero evidence. They failed to recover the fatal bullet and cannot confirm the caliber, or type of weapon used. Also, the prosecutions star witness in the case is an illegal alien who admitted to being a drug mule for the cartels."
