Jack Smith Gets 'Worst Possible Outcome' In Trump Documents Case

 March 16, 2024

Jack Smith just received what many experts are saying might be the worst possible outcome for his crusade against former and future president Donald Trump.

Despite Judge Aileen Cannon not particularly agreeing with Donald Trump's attorneys that the former president's classified documents case should be dismissed, she did seem to extend an olive branch to their side.

Cannon said that "rather than prematurely decide now," she denied the motion for dismissal so that it could be "raised as appropriate in connection with jury-instruction briefing and/or other appropriate motions."

This is a HUGE win for Trump.

Why?

Because if Trump raises the question after the jury briefing, Smith CAN'T appeal it.

Some people are accusing Cannon of being "intentionally dumb" by putting out a ruling that seems to be anti-Trump at first glance but might actually be EXACTLY what Trump needs to survive.

"It’s what I’d call an ugly win for the government. The Judge dismissed the vagueness argument—but just for today. She did it ‘without prejudice,’ which means that Trump’s lawyers could raise the argument again later in the case. In fact, the Judge seemed to do just that in her order, essentially inviting the defense to raise the argument again at trial," said former U.S. Attorney Joyce Vance.
