Judge Juan Merchan ruled Tuesday that former President Donald Trump can attend son Barron's high school graduation on May 17, although he did not make it clear whether any trial activities would happen that day without him.

Trump has been required to be in court each day of the trial, expected to last six to eight weeks from its start on April 15.

His lawyers filed on one of the trial's first days for Trump to be allowed to attend the graduation, but Merchan said he would rule on the request at a future time.

"(Barron’s) a great student and he’s very proud of the fact he did so well and was looking forward for years to having his graduation with his mother and father there, and it looks like the judge isn’t going to allow me to escape this scam. It’s a scam trial," Trump said last month as the trial started.

The graduation requires Trump to leave Manhattan, since it is in Florida near his home at Mar-A-Lago.

Trump said again on Tuesday that the trial was a "scam" intended to keep him from campaigning for president as well as stumping for other Republican candidates.
