Alabama Supreme Court will not revisit frozen embryo decision

Alabama's Supreme Court declined to reconsider a controversial ruling that found that frozen embryos are considered children under a state law in a decision on Friday.

The court rejected a request to review the ruling in a decisive 7-2 decision.

Back in February, Alabama's Supreme Court ruled that three couples could pursue wrongful death lawsuits for their “extrauterine children” after their frozen embryos were destroyed in storage.

The decision quickly caused confusion and led to fertility clinics temporarily shutting down because of the decision's implications. The situation was resolved when state lawmakers approved legislation shielding providers from civil lawsuits.

However, that wasn't enough for the Center for Reproductive Medicine and the Mobile Infirmary, which requested a rehearing of the issue.

But that request was promptly denied, and it seems that Alabama's Supreme Court is settled on the issue.
