Trump Argues Proposed Protective Order Violates First Amendment

 August 9, 2023

Donald Trump has some strong opinions about the protective order that Special Counsel Jack Smith has proposed in the latest federal case brought against him. He's claiming that it would be violative of the Bill of Rights.

Trump's legal team filed 29 pages on Aug. 7 explaining that Smith's protective order should be narrowed to prevent infringement upon the former president's First Amendment liberties.

Smith requested the order after Trump posted on social media:

IF YOU GO AFTER ME, I’M COMING AFTER YOU

Now, Trump's team is calling out the proposed protective order, arguing that it is currently "overbroad" and needs "to shield only genuinely sensitive materials from public view."

"In a trial about First Amendment rights, the government seeks to restrict First Amendment rights," Trump's team said. "Worse, it does so against its administration’s primary political opponent, during an election season in which the administration, prominent party members, and media allies have campaigned on the indictment and proliferated its false allegations."
