McCaskill: Biden classified documents make it 'very difficult' to hold Trump criminally liable

Another Democrat, MSNBC contributor Claire McCaskill, admitted on Tuesday that the President Joe Biden classified document situation would make it "very difficult" to hold former President Donlad Trump criminally liable for his own document situation in the wake of the raid at Mar-A-Lago by the FBI.

After agreeing with Morning Joe co-host Mika Bresinski that Trump's situation was far worse than Biden's, McCaskill said that those on the left who hate Trump for no good reason (my paraphrase) "need to have a sober moment because when a jury is trying to figure out whether someone should be held criminally responsible, that’s going to be in their head."

The "that" she was referring to is the idea that Trump and Biden's situations cancel each other out.

As a prosecutor, she said, "it is probably very difficult [to make a criminal case against Trump now] because the whataboutism is going to be rampant in that jury room. I think it’s important for us to recognize it may not be fair, it may not be right, but that’s the reality of where we are.”

McCaskill is right; there's no way the DOJ could criminally charge Trump now without also criminally charging Biden, unless they want a backlash so strong it could knock Biden right out of the White House come 2024.
