Judge orders Eric Adams, Trump DOJ officials to court over motion to dismiss

New York City Mayor Eric Adams and some of President Donald Trump's Justice Department officials were ordered to appear in court by a judge after they moved to dismiss corruption charges against him that Joe Biden's DOJ filed.

According to Fox News, U.S. District Judge Dale Ho ordered both parties to appear in court earlier this week.

The judge also told Adams to file his "consent in writing" to the motion to dismiss to the court docket.

It was pointed out by Ho that Trump's DOJ mentioned that Adams had filed his "consent in writing" but no such consent was submitted to the court for review.

The Justice Department, in its motion to dismiss the charges against Adams made it clear where it stands on the issue.

"The executive branch remains the absolute judge of whether a prosecution should be initiated and the first and presumptively the best judge of whether a pending prosecution should be terminated," it said.

It added, "The exercise of its discretion with respect to the termination of pending prosecutions should not be judicially disturbed unless clearly contrary to manifest public interest."

The judge pushed back, making the argument that he needed to ensure that the reasons for the motion to dismiss were "substantial."

Fox News noted:

Ho, however, cited legal history, noting that a judge has independent obligations once the government has involved the judiciary by obtaining an indictment or a conviction. Additionally, he quoted from one judicial opinion that said a judge must be "satisfied that the reasons advanced for the proposed dismissal are substantial" before approving a dismissal.

In a late-breaking update, according to NBC News, Ho delayed his decision on whether or not to dismiss the charges as requested by Trump's Justice Department.

Ho indicated that there's more to go over for a decision to be made but admitted that he doesn't want the case to "drag on" for too long.

"I’m not going to shoot from the hip right here on the bench,” Ho said. “I want to make sure that I consider everything appropriate, and that I don’t consider anything inappropriate, and make a reasoned decision that is mindful of my role, which I understand here is quite narrow."

New York Gov. Kathy Hochul is reportedly considering removing Adams from power pursuant to her authority under the state constitution.

It'll be interesting to see how the left reacts if the judge ultimately drops the charges as requested.
