Judge keeps Trump classified documents report private as co-defendants still face trial

Florida federal Judge Aileen Cannon ruled Tuesday that the DOJ may not release former special counsel Jack Smith's report on the dismissed classified documents case against President Donald Trump until after his two co-defendants' cases have gone to trial.

Former Attorney General Merrick Garland wanted the report released, but that request has been blocked for now.

Cannon noted that no lawmakers had even asked for the report.

"With respect to the Department’s assertion of congressional interest in Volume II, there has been no subpoena by Congress for review or release of Volume II," Cannon wrote.

With Trump now heading the DOJ, Walt Nauta and Carlos De Oliveira's cases are likely to be dismissed, but that hasn't happened yet.

"There is no 'historical practice' of providing Special Counsel reports to Congress, even on a limited basis, pending conclusion of criminal proceedings," Cannon added.
