Judge dismisses lawsuit seeking to kick Donald Trump off of the ballot

Judge Robin Rosenberg, an Obama-era appointee, dismissed a lawsuit seeking to bar former President Donald Trump from the presidential ballot using the Constitution’s Fourteenth Amendment.

The suit was filed by Florida attorney Lawrence Caplan who cited the Fourteenth Amendment clause providing that any individual “engaged in insurrection or rebellion against” the United States is ineligible to hold office.

Caplan and many others have attempted to argue that Trump's alleged actions on Jan. 6th, 2021 constituted an insurrection or rebellion despite no conviction of any kind having been secured against Trump for such an offense.

The left has been desperate to stop Trump, and liberals believe the Fourteenth Amendment is their best shot.

Breitbart News reported, "Former Clinton administration labor secretary Robert Reich was recently joined by legal scholars William Baude and Michael Stokes Paulsen, both Never Trump members of the otherwise conservative Federalist Society, who wrote in the University of Pennsylvania Law Review that Section 3 “disqualifies former President Donald Trump, and potentially many others, because of their participation in the attempted overthrow of the 2020 presidential election."

So far, those legal scholars' arguments are falling flat in courtrooms around the United States, and it seems that Trump will be on the ballot opposite President Joe Biden in next year's presidential election.
