The Indiana Supreme Court has agreed to hear oral arguments in the Delphi double murder case against Richard Allen in January, a local Fox News affiliate reported.

Specifically, the court will decide whether Allen's original legal team can be reinstated, and Special Judge Fran Gull removed from the trial.

Allen also requested a trial be scheduled within 70 days of the court's ruling.

Gull removed Bradley Rozzi and Andrew Baldwin from the case in October when crime scene evidence was leaked online. Gull blamed the leak on Allen's attorneys and accused them of being "grossly negligent."

The leak was later attributed to a co-worker of Baldwin's who took photos of the evidence when it was left out in the office.

Prosecutors urged the court to reject the petition because an appeal was not filed, as is the normal procedure.
