U.S. Court of Appeals for the Fifth Circuit shoots down bump stock ban

U.S. Court of Appeals for the Fifth Circuit issued a massive 13-3 decision finding that a Trump-era ban on bump stocks was unconstitutional on Friday.

Circuit Judge Jennifer Walker Elrod wrote the majority opinion and pointed out that the ban did not provide a "fair warning that possession of a non-mechanical bump stock is a crime."

The rule, which was issued on Dec. 18, 2018, gave Americans 90 days to hand their bump stocks over to authorities. The rule defined bump stocks and similar devices as "machineguns."

Judge Elrod also noted that "A plain reading of the statutory language, paired with close consideration of the mechanics of a semi-automatic firearm, reveals that a bump stock is excluded from the technical definition of ‘machinegun’ set forth in the Gun Control Act and National Firearms Act.”

The ruling represents a crucial win for freedom as the bump stock ban was a travesty from the beginning.

The federal government was effectively given carte blanche to define a gun as a machine gun based on an accessory. Thankfully the Fifth Circuit court saw through that and have set things right.
