Musk’s DOGE initiative blocked by GAO over jurisdiction limits

 May 18, 2025

Efforts by Elon Musk’s government efficiency department to intervene in a congressional auditing agency have been firmly rebuffed.

According to Politico, the Government Accountability Office declined a request from the Department of Government Efficiency to assign federal downsizing personnel to its workforce, citing independence from executive control.

The Department of Government Efficiency, or DOGE, recently attempted to position a downsizing team within the Government Accountability Office, an independent agency that investigates how the federal government spends taxpayer dollars. This move, revealed in a Friday bulletin to all GAO staff, was framed by DOGE as an initiative to broaden cost-cutting efforts across federal entities.

DOGE, which was established by executive order under former President Donald Trump, is currently led by entrepreneur Elon Musk. The department’s goal is to streamline government operations and identify inefficiencies. Despite its aims, DOGE’s authority does not reach into the legislative branch.

GAO swiftly responded to the attempted placement with a formal letter to DOGE’s acting administrator, Amy Gleason. Gleason, a veteran in health care and technology, received the agency's clarification regarding jurisdictional boundaries between the executive and legislative branches.

GAO Underscores Independence From Executive Power

In its response, GAO made it clear that it does not fall under the executive branch. Instead, the agency supports Congress directly and operates independently to maintain nonpartisan evaluations of government programs and spending.

The letter specifically stated that the watchdog agency is not obligated to take direction from DOGE because of its legislative affiliation. According to excerpts shared with staff, GAO asserted that it is "not subject to DOGE or Executive Orders."

To ensure transparency, GAO notified the appropriate congressional committees about the situation. The agency also promised to keep lawmakers updated on any further developments that might impact its autonomy or mission.

Congressional Watchdog Emphasizes Core Mission

Following the exchange, GAO leadership issued a bulletin to its employees reaffirming the agency's mission and its dedication to accuracy, objectivity and professionalism in its role supporting Congress.

The bulletin reminded staff that GAO's purpose is to help lawmakers fulfill their constitutional responsibilities. It also thanked employees for continuing their work in what the agency described as a principled and nonpartisan manner.

GAO’s approach reflects the organization’s long-standing emphasis on upholding integrity while serving members of Congress and avoiding partisan influences from other branches of government.

Attempt Raises Issues Over Executive Outreach

A spokesperson from GAO confirmed reports of DOGE's request and noted the department's origins in an executive order issued by the previous administration. The spokesperson reiterated that GAO, as part of the legislative branch, is not compelled to follow orders from the executive branch.

Based on that principle, GAO denied the request outright and declined to host any DOGE personnel. The agency emphasized its structural and functional separation from organizations like DOGE that operate under direct presidential authority.

The incident has sparked questions about the extent to which executive initiatives can interact with or influence independent congressional agencies. GAO’s firm rejection may set a precedent for similar future overtures.

Background of the Controversial Efficiency Push

The Department of Government Efficiency was formed as part of a broader government reform initiative intended to reduce redundancy and cut federal spending. Musk’s leadership has been marked by aggressive reshaping efforts aimed at streamlining operations across agencies.

DOGE has already implemented downsizing strategies in several executive-controlled departments. However, legislative bodies like GAO remain outside its legal reach, something GAO made abundantly clear in both internal and external communications.

The internal bulletin reassured employees that the agency had taken appropriate action and stood by its commitment to independent review processes. The message underscored that congressional support and oversight continue to guide GAO operations.

Future of DOGE’s Strategy Remains Unclear

It is not yet known whether DOGE plans to pursue additional efforts to collaborate with or monitor independent agencies. The organization has thus far not released a public statement regarding GAO’s refusal.

This recent push from DOGE may suggest broader ambitions that go beyond the executive agencies that typically fall under its domain. How these strategies will evolve under Musk’s leadership remains to be seen.

For now, GAO’s firm stance reinforces the boundaries between the branches of government, particularly when it comes to preserving impartial oversight functions essential to accountability in federal operations.
